Refund policy

This Refund and Cancellation Policy explains the circumstances in which refunds may be provided in connection with Competitions operated by MELIORA SELECTS LIMITED ("Meliora Selects", "we", "us" or "our").
This Policy should be read together with our Terms and Conditions. Capitalised terms used in this Policy have the meanings given to them in our Terms and Conditions unless otherwise stated.
Nothing in this Policy affects your statutory rights under applicable UK law.
1. COMPETITION ENTRIES
1.1 Except where expressly provided in this Policy, our Terms and Conditions or required by applicable law, paid Entries into a Competition are non-refundable once they have been accepted by us.
1.2 Each Entry relates to participation in the specific Competition selected at the time of entry.
1.3 A change of mind after an Entry has been accepted does not ordinarily entitle an Entrant to a refund.
1.4 Nothing in this Policy excludes or restricts any statutory right to a refund or other remedy which cannot lawfully be excluded.
2. COMPETITIONS WILL NOT BE CANCELLED DUE TO LOW ENTRY NUMBERS
2.1 Each Competition is intended to proceed and the advertised Prize is intended to be awarded regardless of the number of Entries received.
2.2 We will not cancel a Competition, extend its Closing Date, or reduce or substitute the advertised Prize for a prize of lower value solely because an insufficient number of Entries have been received.
2.3 Entry numbers or the commercial performance of a Competition shall not, by themselves, constitute grounds for cancellation or extension.
3. EXCEPTIONAL CIRCUMSTANCES
3.1 In accordance with Clause 9 of our Terms and Conditions, we may suspend, postpone, amend or, where reasonably necessary, cancel a Competition where exceptional circumstances outside our reasonable control make it impossible, unlawful, unsafe or materially impracticable to conduct or conclude the Competition substantially as originally advertised.
3.2 Such circumstances may include:
(a) a material failure or disruption of essential technology, payment, hosting or other third-party services;
(b) fraud, attempted fraud, manipulation, abuse or a material compromise of the integrity or security of a Competition;
(c) a change in applicable law or regulation, or intervention by a competent regulatory or governmental authority;
(d) the advertised Prize becoming genuinely unavailable for reasons outside our reasonable control;
(e) fire, flood, natural disaster, war, civil disorder, public health emergency or other event of force majeure; or
(f) another exceptional circumstance outside our reasonable control which prevents a Competition from being conducted or concluded fairly, lawfully or substantially in accordance with its advertised terms.
3.3 Where reasonably practicable, we will seek to preserve the Competition and the validity of existing Entries before cancelling or materially amending it.
4. CANCELLATION OF A COMPETITION
4.1 Where a Competition is cancelled in accordance with Clause 9 of our Terms and Conditions, each affected Entrant who purchased one or more Entries shall be entitled to a refund equal to the amount paid in respect of those Entries.
4.2 No monetary refund shall be payable in respect of a Free Postal Entry because no payment is made to us for that Entry.
4.3 Where a Competition is cancelled, we will communicate the cancellation clearly on the Website and, where reasonably practicable, directly to affected Entrants.
4.4 The cancellation notice will provide affected Entrants with relevant information concerning the refund process.
5. SITE CREDIT AS AN ALTERNATIVE TO A REFUND
5.1 Where a monetary refund is payable, we may offer the affected Entrant the option of receiving Site Credit of equivalent value instead.
5.2 Acceptance of Site Credit shall be entirely voluntary.
5.3 Site Credit shall not be imposed in place of a monetary refund where the Entrant is entitled to a monetary refund under our Terms and Conditions.
5.4 Where an Entrant voluntarily elects to receive Site Credit instead of a monetary refund, the Site Credit shall be applied to their Account and shall be subject to the Site Credit provisions contained within our Terms and Conditions.
5.5 Any applicable expiry date or usage condition shall be communicated clearly before the Entrant accepts Site Credit as an alternative to a monetary refund.
6. OTHER CIRCUMSTANCES IN WHICH WE MAY ISSUE A REFUND
6.1 We may issue a refund where:
(a) an Entry has been accepted in error;
(b) a Competition cannot reasonably proceed because of exceptional circumstances described in Clause 9 of our Terms and Conditions;
(c) an Entry is invalidated and we determine that a refund is appropriate in the circumstances;
(d) an Entry has been accepted in excess of a published Entry Limit and is subsequently cancelled;
(e) a duplicate or erroneous payment has been identified; or
(f) a refund is otherwise required by applicable law.
6.2 Where an Entry is invalidated because of fraud, attempted fraud, manipulation, deliberate abuse, an improper chargeback or another material breach of our Terms and Conditions, a refund shall not automatically be due and shall be subject to our Terms and Conditions and applicable law.
7. EXCESS ENTRIES
7.1 Where a maximum Entry Limit applies to a Competition, that limit shall be displayed on the relevant Competition Page.
7.2 Where a paid Entry is accepted in excess of the applicable published Entry Limit, we may cancel the excess Entry and refund the amount paid in respect of it.
7.3 Where offered, the Entrant may voluntarily elect to receive equivalent Site Credit instead of the monetary refund.
8. PROCESSING REFUNDS
8.1 Where a monetary refund becomes payable under this Policy or our Terms and Conditions, we shall endeavour to process the refund within fourteen (14) days after entitlement to the refund has been established.
8.2 Refunds shall ordinarily be made using the original payment method used to purchase the Entry.
8.3 Where repayment using the original payment method is not reasonably practicable, we may arrange an alternative reasonable method of repayment.
8.4 Once a refund has been processed by us, the time taken for the funds to appear in the Entrant's account may depend upon the relevant bank, card issuer or payment service provider.
8.5 We shall not be responsible for delays caused solely by banks, payment providers or other third parties involved in processing a refund and which are outside our reasonable control.
9. CHARGEBACKS AND PAYMENT REVERSALS
9.1 Entrants should contact us in the first instance where they believe a payment has been taken incorrectly or they believe they are entitled to a refund.
9.2 Where a payment is reversed, cancelled, charged back or otherwise recovered, we may take reasonable action in accordance with our Terms and Conditions, including cancelling affected Entries where payment for those Entries has not been received or has subsequently been reversed.
9.3 Nothing in this section prevents an Entrant from exercising any lawful rights available through their bank, card issuer, payment provider or under applicable consumer law.
10. PRIZE SUBSTITUTION
10.1 Prize substitution shall be governed by Clause 13 of our Terms and Conditions.
10.2 Where circumstances outside our reasonable control make an advertised Prize genuinely unavailable, we may substitute a reasonable equivalent of the same or greater value and, where reasonably practicable, of a substantially similar nature.
10.3 A Prize shall not be reduced or substituted for a prize of lower value solely because a Competition has received fewer Entries than anticipated.
11. COMPLAINTS AND REFUND QUERIES
11.1 If you believe that you are entitled to a refund, believe that a payment has been taken incorrectly, or have a complaint concerning the cancellation or administration of a Competition, please contact us using the contact details published on the Website.
11.2 Please provide sufficient information to allow us to investigate your query, including where applicable:
(a) your full name;
(b) the email address associated with your Account;
(c) the relevant Competition;
(d) your order or Entry details; and
(e) a brief explanation of the issue.
11.3 We shall investigate refund queries and complaints fairly and within a reasonable period.
12. RELATIONSHIP WITH OUR TERMS AND CONDITIONS
12.1 This Policy forms part of the information governing refunds and cancellations in connection with our Competitions and should be read together with our Terms and Conditions.
12.2 In the event of any inconsistency between this Policy and our Terms and Conditions, the Terms and Conditions shall prevail to the extent permitted by law.
12.3 Nothing in this Policy shall exclude, restrict or otherwise affect any statutory rights or remedies available to consumers under applicable UK law.
